Aceptación del Acuerdo.

You agree to the terms and conditions outlined agreement with respect to our site, products, and services (the “Site”). You must be of legal age to use our site and to enter into this Agreement. This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site. To the extent you or your organization has entered into a Software as a Service Agreement (“SaaS Agreement”) with MMC, in the event of a conflict, inconsistency or ambiguity between any term or provision set forth in these Terms and Conditions and the SaaS Agreement, such term or provision of the SaaS Agreement shall control and supersede any such conflict, inconsistency or ambiguity.

Acceso a SAP, formación y otras suscripciones

Nuestro acceso a SAP y la capacitación de SAP y otras suscripciones se rigen por los siguientes términos:

• El acceso a nuestro sistema SAP es solo para uso educativo personal. La actividad comercial no está permitida con nuestros paquetes de acceso remoto de SAP.
• No puede copiar, distribuir ni vender ninguna información que reciba en relación con la compra de nuestros productos y servicios.
• No emitimos reembolsos por ninguna parte no utilizada de los paquetes de acceso a SAP u otras suscripciones.

• SAP training courses can be accessed from up to two (2) computers (i.e. a work computer and a home/laptop computer) to prevent unauthorized access. Prior authorization for each computer is required before training courses can be accessed. Your computer must accept cookies to be authorized. Do not delete or otherwise move these cookies as this will invalidate your authorization. All authorizations are subject to MMC’s review and approval.

• All subscriptions renew automatically until canceled. Cancelations must be received by our office at least three (3) days prior to the renewal; We cannot cancel subscriptions retroactively. To cancel, simply send us an email. If you don’t want your subscription to automatically renew, send us an email. Any refunds will be issued less the transaction fees charged by the processor.
• MMC monitors, tracks, and records all user access and usage patterns and reserves the right to revoke access privileges at any time with or without notice in MMC’s sole discretion.
• Any courses purchased as part of a monthly subscription shall remain available until the earlier of (i) the course is discontinued at MMC’s sole discretion, or (ii) the termination of the monthly subscription.
• Any courses purchased individually shall remain available for six months and shall automatically expire thereafter.
• 100% Satisfaction guarantee: You can try our products and services for ten (10) days. If you do not like them, simply tell us in the first ten (10) days, and we will issue a refund of the purchase price less the processing fees to your account. Note: We cannot issue any refunds after ten (10) days, or for training courses that you have begun. Also, there are no refunds for corporate products and services (such as corporate training subscriptions or dedicated SAP access subscriptions).
• Violations of these terms and conditions can lead to immediate loss of access privileges without notice and without refunds of unused portions of access.

Artificial Intelligence

Some of our products rely on machine learning, natural language processing, or other forms of artificial intelligence. You are solely responsible for ensuring that the data you input into the any of our services that incorporate AI comply with all applicable laws. Further, you are solely responsible for evaluating the accuracy and appropriateness of our AI system’s output for your use case. You allow us to use data or content that you submit, post or otherwise transmit to us (other than personal data, as that term is defined under applicable data protection laws) for any purpose, including to develop, refine or improve our AI models. The data used for AI training may include inputs and outputs associated with your use of our services, excluding any personal data (as defined under applicable data protection laws). You may withdraw consent to AI training at any time in your account settings. Upon receipt of such notice, we will cease using your data prospectively for AI Training, and you will lose access to our AI Features. You must not, and may not aid third parties to, use our services to directly or indirectly create or train any other AI system.

Indemnización.

You agree to indemnify, defend, and hold us and our partners, attorneys, staff and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense, including reasonable attorneys’ fees, related to your violation of this Agreement or use of the Site or directly related to your use of the Site.

Intransferible.

WE WILL NOT BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND THAT MAY RESULT FROM USE OF OR INABILITY TO USE OUR SITE. OUR MAXIMUM LIABILITY TO YOU UNDER ALL CIRCUMSTANCES WILL BE EQUAL TO THE PURCHASE PRICE YOU PAY FOR ANY GOODS, SERVICES OR INFORMATION WITHIN THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEEDING THE EVENT GIVING RISE TO YOUR CLAIM.

This Agreement shall be treated as though it were executed and performed in San Francisco, California, USA, and shall be governed by and construed in accordance with the laws of the State of California (without regard to conflict of law principles). Any cause of action by you with respect to the Site (and/or any information, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth in Section 8 and Section 10. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against either party. All legal proceedings arising out of or in connection with this Agreement shall be brought solely in San Diego, CA. You expressly submit to the exclusive jurisdiction of said courts and consents to extra-territorial service of process. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision.
